LA AMAZONIA ECUATORIANA

La Confederación de Nacionalidades Indígenas del Ecuador CONAIE, La
Confederación de Nacionalidades de la Amazonia Ecuatoriana CONFENAE,
y la Nacionalidad Waorani del Ecuador NAWE, denuncian ante el país, a
la opinión publica, a los organismos internacionales, a los medios de
comunicaciones, por el genocidio ocurrido el pasado 4 y 6 de febrero
del año en curso, donde 5 hermanos Waoranis entre hombres, mujeres,
ancianos y niños fueron asesinados brutalmente por las empresas
madereras Colombianas y Ecuatorianas. Este genocidio se viene dando
continuamente en la amazonía por parte del estado Ecuatoriano, a
causa de las políticas de concesiones mineras, petroleras, madereras
en nuestros territorios.

Denunciamos la violación a los Derechos Colectivos y Ambientales
contemplados dentro de la vigente Constitución Política de la
Republica, en los Art. 83, 84, 88 y 92.

Responsabilizamos directamente al Presidente de la República, a la
Ministra de Ambiente, al Ministro de Energía, Ministro de Defensa y
Ministro de Gobierno, quienes deberán asumir la demanda que
realizaremos ante la Corte Penal Internacional del estatuto de Roma,
porque son quienes desde diferentes gobiernos año tras año viólan
los derecho de las Nacionalidades voluntariamente aislados en sus
territorios libres de más de 2 millones de hectáreas.

Desconocemos la exigencia de la zona intangible en territorios
libres ancestralmente, donde se asientan las Nacionalidades Tagaeri
– Taromenane y Waoranis. Ser zona intangible expone su extinción
como seres humanos, permite la intromisión abierta a las empresas
petroleras, madereras y mineras a nuestros territorios, además su
presencia se contradice completamente a la declaratoria del
Presidente en cuidar y proteger esta zona.

Exigimos la inmediata renuncia de la Ministra de Ambiente por no
haber precautelado el derecho a la vida y supervivencia de los
hermanos Tagaeri – Taromenane, pese a la crítica situación de
amenaza que viven hace varios años que motivó a que el 10 de mayo
del 2006 la Comisión Interamericana de Derechos Humanos dicte medidas
Cautelares a favor de estas nacionalidades.

Exigimos la salida inmediata de las empresas madereras, mineras,
petroleras, que invaden los territorios libres, violando las medidas
provisionales y la Política Nacional de Pueblos en Aislamiento
puesta en vigencia por el actual Gobierno en abril del 2007, que
establece “la aplicación del principio de responsabilidades por
omisión para aquellas autoridades que permiten la extracción de
madera” en estos territorios.

Ponemos a conocimiento que las 10 nacionalidades de la Amazonía no
hemos respondido nunca ante estos continuos ataques, agresiones,
violaciones de todo tipo, entre otras, a pesar de tener las
herramientas y conocimientos necesarios para ellos, mas todavía hemos
entregado parte de nuestros territorios a migrantes colones para que
puedan realizarse dignamente como seres humanos. Sin embargo, ante
un contexto que pone en peligro nuestra existencia, en defensa de
nuestro derecho a la vida en calidad de seres humanos de esta y las
siguientes generaciones, ante la completa ausencia de las garantías
del estado ecuatoriano, no dudaremos en defendernos.

Ministerial Agreement M.B.S. 01734 – 24 August 1989

The Confederation of Ecuadorian Indigenous Nations, the Confederation of Nations of Ecuadorian Amazonia and the Waorani Nation of Ecuador (NAWE), condemn before the Country, before public opinion, before international organizations and before the media of communication, the genocide which took place on 5 and 6 February 2008, when five Waorani brothers, among men, women, elders and children were brutally murdered by Colombian and Ecuadorian timber companies. This genocide takes place in Amazonia continually, backed by the Ecuadorian State and caused by the policy of granting mineral, oil and timber concessions in our territories.

We denounce the violation of Collective and Environmental Rights enshrined in Articles 83, 84, 88 and 92 of the current Political Constitution of the Republic.

We hold the President of the Republic, the Minister of the Environment, the Minister for Energy, the Minister of Defence and the Minister of Government directly responsible. They will have to answer the demand we shall make before the International Criminal Court of the Statute of Rome, because it is they who, year after year under various governments, violate the rights of the Nations in voluntary isolation in their free territories of more than two million hectares.

We do not recognise the need of the intangible area in ancestrally free territories which are homes of the Tagaeri, Taromenane and Waorani Nations. Its being an intangible area exposes them to extinction as human beings and allows open intrusion into our territories of oil, timber and mining companies whose presence, moreover, entirely contradicts the President’s declaration of intent to care for and protect this area.

We demand the immediate resignation of the Minister of the Environment, since she did not take steps in advance to protect the Tagaeri and Taromenane brothers’ lives and survival, despite their having been in a critically threatening situation for several years, which moved the Inter-American Human Rights Commission to issue precautionary measures in favour of these Nations on 10 May 2006.

We demand the immediate departure of the timber, mineral and oil companies, which invade free territories, violating the provisional measures and the National Policy on Peoples in Isolation which were put in place by the present Government in April 2007 and which establish ‘application of the principle of responsibility by omission for those authorities which permit the extraction of timber’ in those territories.

We make it known that we ten Amazonian Nations have never responded to these continuous attacks, aggressions, and violations of all kinds, despite having the necessary tools and knowledge, but have nonetheless given up parts of our territories to migrant colonists so that they can live in a manner fitting to human beings. However, faced with a situation which puts our existence in peril, faced with complete absence of the Ecuadorian State’s guarantees, and in defence of our and our descendants’ right to live as human beings, we shall not hesitate to defend ourselves.

Ecuador has an oil production rate of 400.000 barrels per day,each year more than 32.000 barrels are spilt into the river systems. This means that every 2 -3 years, a spill as big as the “Exxon Valdez” takes place in the Amazon. Not surprisingly, most part of these areas happen to be inhabited by indigenous people.

“Ecuadorian officials from the recently elected left government in Ecuador made un unprecedented movement last May when they told the UNFII (United Nations Permanent Forum on Indigenous Issues) in New York that their government would ban exploitation of huge oil reserves if it was compensated by the international community for its effort to save the natural habitat of the Amazon region.

The untapped oil reserves are located in the heart of the Amazon, considered by scientists to be one of the most bio-diverse rainforests in the world and also the home of Indigenous People that they still live in complete isolation. If explored and developed, the fields are expected to deliver more than 900 million barrels of oil.

Some of those in solidarity with the indigenous struggles welcome the proposal of the Ecuadorian government, but they also have serious objections to what they see as an attempt to put a dollar price on native people’s right to exist”

The State will emit certificates for the crude oil of Yasuní, and promise to keep the crude underground forever and use the funds to better protect Yasuní National Park.

The arguments in favor of this proposal are:

1. This proposal is the only unquestioned solution to climate change
2. Conservation of biodiversity
3. Protection of the indigenous inhabitants of Yasuní
4. Transformation of the Ecuadorian economy away from oil

Ecuador tiene una producción de petroleo de 400.000 barriles por día, cada año más de 32.000 barriles se vierten en el sistema de ríos. Esto significa que cada 2-3 años se produce en el Amazonas, un vertido tan grande como el “Exxon Valdez”. No es una sorpresa, que la mayor parte de estas areas están habitadas por pueblos indígenas.

“Representantes del gobierno de izquierdas Ecuador, recientemente elegido, hicieron un movimiento sin precedentes el pasado mes de Mayo, cuando anunciaron en el Foro de Naciones Unidas para Asuntos Indígenas en Nueva York, que su gobierno prohibiría la explotación de grandes reservas de petroleo si fuese compensado por la comunidad internacional por sus esfuerzos en salvar el hábitat natural de la región amazónica.

Las reservas petroleras sin explotar están localizadas en el corazón de el Amazonas, considerado por los científicos como uno de los bosques tropicales más biodiversos del mundo, y también hogar de pueblos indígenas que viven en un aislamiento completo. Si estos campos petroleros se explotan, y se desarrollan, se espera que produzcan más de 900 millones de barriles de petroleo.

Algunos que están en solidaridad con las luchas indígenas han bienvenido la propuesta del gobierno de Ecuador, pero también tienen serias objeciones a llo que puede ser visto como un intento de poner un precio en dólares al derecho que tiene la gente nativa a existir”

El estado emitirá certificados por el crudo del Yasuní, y promete que dejará el petroleo bajo tierra para siempre y usará los fondos para proteger al Parque Nacional Yasuní.

Los argumentos a favor de esta propuesta son:

1. Esta propuesta es la única solución posible en relación al cambio climático
2. Conservación y biodiversidad
3. Protección de los habitantes indígenas del Yasuní
4. Transformación de la economía ecuatoriana para abondonar su dependencia del petroleo
